This Privacy Policy and Portfolio Use Disclosure (“Policy”) outlines how Wiz Marketing (“Company,” “we,” “our,” or “us”) collects, uses, and protects client information, as well as the limited rights reserved by the Company to showcase completed work. This Policy is intended to comply with applicable laws of the Commonwealth of Virginia and relevant federal regulations within the United States.
By engaging Wiz Marketing for services, you (“Client”) acknowledge and agree to the terms set forth herein.
2. Information Collection & Use
Wiz Marketing may collect business-related information necessary to perform services, including but not limited to:
• Business name and contact details
• Project specifications and deliverables
• Website content and digital assets provided by the Client
We do not sell, rent, or distribute client information to third parties for marketing purposes.
3. Portfolio Use & Limited Display Rights
Wiz Marketing reserves the right to display completed work strictly for portfolio, demonstration, and marketing purposes, under the following conditions:
• Only public-facing project elements (such as website layout, structure, or non-sensitive design work) may be displayed.
• No personal, confidential, or proprietary information will be disclosed.
• Client branding elements (including logos, service descriptions, or identifiable business information) may be modified, anonymized, or excluded at the Company’s discretion.
• Portfolio use is strictly limited to showcasing the quality and scope of completed work and shall not imply endorsement beyond the existence of a professional relationship.
4. Consent & Authorization
By entering into a service agreement with Wiz Marketing, the Client grants limited, non-exclusive, royalty-free consent for the Company to use completed project materials in accordance with Section 3 of this Policy.
If a Client wishes to opt out of portfolio inclusion, such request must be submitted in writing prior to or upon project completion.
5. Intellectual Property & Use Restrictions
All deliverables provided remain subject to applicable intellectual property laws. Clients are advised:
• Not to reproduce, resell, or misuse proprietary strategies, systems, or materials developed by Wiz Marketing without written authorization.
• That unauthorized use, duplication, or distribution of protected materials may result in legal action under applicable state and federal law.
6. Legal Compliance & Governing Law
This Policy is governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles.
Additionally, Wiz Marketing operates in compliance with applicable federal laws, including but not limited to:
• Consumer protection and fair business practice regulations
• Intellectual property protections under U.S. law
• Applicable data protection and privacy standards
Any disputes arising under this Policy shall be subject to the jurisdiction of courts located within the Commonwealth of Virginia.
7. Limitation of Liability
Wiz Marketing shall not be held liable for:
• Misuse of services or deliverables by the Client or third parties
• Unauthorized alterations made after project delivery
• Damages resulting from Client-provided materials or instructions
8. Client Responsibility & Acknowledgment
Clients are strongly advised to review this Policy in full to avoid:
• Infringement of intellectual property rights
• Misuse of services, products, or solutions provided
• Misunderstanding regarding portfolio usage rights
This document serves as formal notification of Wiz Marketing’s policies and practices.
9. Policy Updates
Wiz Marketing reserves the right to update or modify this Policy at any time. Continued use of services after updates constitutes acceptance of revised terms.
